New Colorado Rental Laws: What Property Owners Must Know

Summer 2025 Update

The 2025 Colorado legislative session brought sweeping changes to

landlord-tenant law with nine major bills that impact Colorado rental property owners. Here's what you need to know to protect your investment and stay compliant.

Immediate Action Required

HB25-1240: Housing Subsidies Now Mandatory

Effective: May 29, 2025

  • All  landlords  must  accept  housing  subsidies  -  refusal  can  cost  you

$5,000+ per violation

  • Special  rules  for  subsidized  tenants:  30-day  eviction  notices  (vs.  10-day)  and $20 late fee cap

  • Action:  Update your tenant acceptance policies immediately

HB25-1090: Full Price Transparency Required

Effective: April 21, 2025

  • All  rental  ads  must  show  total  price  including  mandatory  fees

  • No hidden utility markups or undisclosed charges

  • Violations treated as deceptive trade practices

  • Action:  Revise all your marketing materials and lease agreements HB25-1168:  Enhanced  Domestic  Violence  Protections  Effective:  May  22,  2025

  • Expanded  protections  for  victims  of  domestic  violence,  stalking,  and sexual crimes

  • Flexible  documentation  options  including  self-attestation

  • Mandatory  no-fee  repayment  plans  within  3  business  days

  • Victims can change locks without penalty (must provide copy)

  • Action:  Update  your  lease  language  and  train  any  staff  or  property managers

HB25-1249: Security Deposit Reform

Effective: January 1, 2026

  • Stricter  "normal  wear  and  tear"  definitions

  • Required pre-move-out inspections if requested

  • 14-day deadline for itemized deduction statements

  • Burden of proof shifts to landlords in disputes

  • No  carpet  deductions  for  units  over  10  years  old

  • Action:  Start  updating  your  move-out  procedures  and  documentation systems  now

HB25-1108: Letty's Act - Tenant Death Protections

Effective: September 1, 2025

  • Eliminates  rent  acceleration  and  penalties  when  lease  ends  due  to tenant death

  • Limits  liability  to  month-end  or  10  business  days  after  vacancy

  • Action:  Review  and  remove  problematic  lease  clauses  before September

Additional Changes

HB25-1207: Pet-Friendly Housing (Effective August 6, 2025)

  • Affordable  housing  developments  must  allow  pets  with  reasonable restrictions

  • Insurance companies can't discriminate based on dog breed

HB25-1236: Tenant Screening Updates (Effective June 2025)

  • No  credit  checks  required  for  subsidized  tenants

  • Portable screening reports valid for 60 days (up from 30)

SB25-020: Enhanced Enforcement (Effective May 28, 2025)

  • Government  agencies  can  now  directly  enforce  landlord-tenant  laws

  • Courts can appoint receivers for neglected properties

Bottom Line

These changes prioritize tenant protections and significantly increase penalties for non-compliance. As a property owner, you should immediately review your policies, update lease agreements, and double check that your property manager is in the know.
